J. David Bogenschutz

David came to Florida in 1971 after graduating from The University of Cincinnati College of Law and Miami University in Oxford, Ohio where he was a member of the Division 1 NCAA intercollegiate golf team, as well as holding multiple offices in fraternity and campus organizations. He practiced for a short period of time in general practice in Xenia, Ohio before taking and passing the Florida Bar. David started his legal career in Florida at the Broward County State Attorney’s Office where he prosecuted the full spectrum of criminal cases from homicides to the most minor misdemeanors. As a felony prosecutor, he was tasked with creating the Special Investigation Division of the State Attorney’s Office, which has now grown in size to over 10 lawyers. David served as the Chief of the Trial Division and eventually Chief Assistant State Attorney.

After 7 years with the State Attorney, in 1977, he joined the prominent criminal defense firm of Varon and Stahl, and continued, now on the defense side, representing multiple public officials, judges, and other clients in state and federal court. His current practice, J. David Bogenschutz & Associates, P.A. was formed after a lengthy stint as senior partner of Bogenschutz, Dutko & Kroll, P.A., and he has long been considered the preeminent criminal defense attorney in Broward County and South Florida by The Miami Herald, The Sun Sentinel, various publications such as Gold Coast Magazine, South Florida Business and Wealth and Business Monthly. David has been recognized in the Naifeh and White publication “Best Lawyer’s in America” for over 25 years, and has also been an AV Rated attorney with Martindale & Hubbel for over 30 years, and has also been recognized by Martindale & Hubbel as a “Preeminent” Attorney for decades up to and including 2018.

David has been a speaker at various Bar sponsored functions such as The Florida Bar Young Lawyer’s Section, Florida Bar’s “Bridge The Gap” for newly admitted attorneys, as well as the Broward County Bar Association Barrister for Law Day in 2016. 

David has been honored as Person of the Year by JAABlog in 2008, “Best Lawyer” by New Times Magazine, and has been the recipient of several awards including The Harry Gulkin Award, the Lynn Futch Professionalism Award from the Broward County Bar Association, Florida Super Lawyers from 2009 to the present, The Wall Street Journal’s Top Attorneys in Florida from 2012 to the present, named as one of America's 38 Best Criminal Attorneys in 2016, The Bar Register of Preeminent Lawyers from 1994 to the present, has been listed in Who’s Who in America Law from 1992 to the present, and has sat on the Eleventh Circuit Court of Appeals Federal Defender Nominating Commission since 2010. He has been a member of the Governor’s Committee on Criminal Justice Standards and Goals, the Bench Bar Liaison Committee for the United States District Court Southern District of Florida, is a Fellow of the American Bar Foundation, has been named one of America’s “Most Honored Professionals” from 2017-2019, and was named as “AV Preeminent – Judicial Edition” by Martindale & Hubbel in 2018 & 2019. He is also a member of the American Bar Association and the National Association of Criminal Defense Lawyers. 

In 2015, David was nominated and elected as a Fellow of the American College of Trial Lawyers (ACTL), a singular honor by an organization comprised of the top 5% of all of the trial lawyers in the United States and Canada, and includes some of the sitting justices of The United States Supreme Court. 


David is admitted to practice in the United States District of Courts for the Southern District of Ohio, the Southern District of Florida, the Eastern District of Wisconsin, the Middle District of Florida, and the Eastern District of Michigan. He is admitted in all state and county courts in the State of Florida including all appellate courts and the Supreme Court of Florida. He is also admitted to the Circuit Courts of Appeals of the Fourth, Fifth, Sixth, and Eleventh Circuits, as well as being admitted to practice before the United States Supreme Court. 
David practices criminal defense, as well as provides representation for judges before the Judicial Qualifications Commission since 1985, and represents clients before state and local administrative agencies including the Commission on Ethics in Tallahassee and agencies providing oversight to various occupations governed by state law including but not limited to physicians, real estate brokers and salesmen, attorneys (The Florida Bar), and other professional groups.
